By accessing the website at alisoviejoconcreteco.com, contacting GoldAssist Aliso Viejo Concrete ("we", "us", or "our"), or engaging us to perform concrete contractor services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, customers, and anyone who interacts with us through our website, phone, or email.
GoldAssist Aliso Viejo Concrete is a concrete contractor based in Aliso Viejo, CA. We provide concrete construction and related services to residential and commercial customers in South Orange County, California. Services include, but are not limited to, driveway installation, patio construction, flatwork, foundation work, retaining walls, and decorative concrete.
All services are subject to availability. We reserve the right to decline any project at our discretion. The scope of work for any specific project is defined by a written proposal or contract provided to the customer before work begins.
All estimates provided by GoldAssist Aliso Viejo Concrete are based on an on-site assessment of the project and the information provided by the customer at the time of the estimate. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
An estimate is not a binding contract. A separate written proposal or service agreement must be signed by both parties before work begins. The written proposal constitutes the full and final price for the described scope of work.
Changes to the scope of work requested by the customer after a contract is signed may result in additional charges. Any changes to the agreed scope will be communicated in writing before additional work is performed. We will not perform out-of-scope work without written authorization from the customer.
Project start dates are scheduled based on crew availability, permit approval timelines, and weather conditions. We will provide a projected start date at the time of contract signing, but dates are subject to change. We will notify you as soon as reasonably possible of any scheduling changes.
If you need to cancel or reschedule, please notify us at least 5 business days before the scheduled start date. Cancellations made less than 5 business days in advance may be subject to a cancellation fee to cover materials ordered or preparation work already performed.
We reserve the right to delay or reschedule work due to weather conditions that would compromise the quality of the concrete installation. We will not charge cancellation fees for weather-related delays initiated by us.
Payment terms are outlined in the written project proposal. A deposit may be required before work begins. The remaining balance is due upon completion of the work, unless otherwise stated in the written agreement.
Accepted payment methods will be listed in the written proposal. Payments not received by the due date may be subject to a late fee as specified in the proposal. Failure to pay may result in suspension of work and may be referred for collection.
Customer satisfaction is important to us. If you have a concern about the quality of completed work, please contact us before withholding payment so we have the opportunity to address it.
You are responsible for providing accurate information about the property, including the location of underground utilities, irrigation lines, gas lines, electrical conduit, and any other buried infrastructure. We are not responsible for damage to undisclosed or unmarked utilities.
Before work begins, you agree to obtain any required approvals from your homeowners association (HOA) and to ensure that access to the work area is clear. Delays caused by inaccessible work areas or missing HOA approvals may affect the project schedule and could be subject to additional charges.
You are responsible for keeping people and pets away from the work area during active construction and for the duration of the curing period as advised by our crew.
Where required by law, GoldAssist Aliso Viejo Concrete will apply for necessary building permits on behalf of the customer. Permit fees are the responsibility of the customer and will be itemized in the written proposal. We perform all work in compliance with applicable California building codes and local municipal requirements. Final sign-off by a city inspector, where required, is part of the project process and does not constitute an additional charge unless otherwise stated.
We stand behind the quality of our workmanship. Any specific warranty terms will be stated in the written project proposal or contract. In the absence of a written warranty, our standard workmanship warranty covers defects in labor and installation for one year from the date of project completion.
Our warranty does not cover damage resulting from misuse, neglect, tree root intrusion, natural settling of the ground, soil movement outside normal conditions, acts of nature, or modifications made by anyone other than GoldAssist Aliso Viejo Concrete after project completion.
Concrete is a natural material and minor surface cracking, color variation, and settling are normal characteristics of concrete and are not covered under warranty. Control joints are installed to manage predictable cracking - cracking at control joints is expected and does not indicate a defect.
To the maximum extent permitted by applicable law, GoldAssist Aliso Viejo Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services, including but not limited to loss of profits, loss of data, or property damage not directly caused by our negligence.
Our total liability to you for any claim arising from or related to our services shall not exceed the total amount paid by you to us for the specific project giving rise to the claim. This limitation applies regardless of the form of action or the basis of the claim.
The content on our website, including text, images, and other materials, is provided for informational purposes only. We make no representations or warranties about the accuracy, completeness, or suitability of this information for any particular purpose.
You agree not to use our website in any way that is unlawful, harmful, or that interferes with the normal operation of the site. We reserve the right to restrict access to the website for any user at any time and for any reason.
We prefer to resolve any disputes directly and informally. If you have a concern about our services or charges, please contact us at hi@alisoviejoconcreteco.com or (949) 284-1683 so we have the opportunity to resolve it.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing formal legal action. Any unresolved disputes will be subject to binding arbitration under the rules of the American Arbitration Association, conducted in Orange County, California.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Orange County, California.
